Background

Scope and content:

The collection consists of a 24 December 1830 summons from William Eskeridge of Staunton Chancery District Court to James White, guardian of David O. K. Hays and Mary Hays, heirs of John Hays. White is ordered to pay Andrew Hays, executor of the John Hays estate, $37.67 for lawsuit costs.

On the reverse of the summons, William Eskeridge asserts on 16 July 1831 that "I have always understood from Major Sheffey that Col. James White of Abingdon was the person referred to in the written accusation." C. P. Dorman, attorney and agent for Andrew Hays, wrote his signature beneath this attestation.

Also written on the reverse of the summons is statement by James White, "I have no recollections of being the guardian of the orphans named David O. N. and Mary Hays. If it is ascertained that I am really the guardian I will answer at any time." He wrote this explanation on 21 May 1831.
